Terms of Use
Last updated: November 2, 2026
These terms govern your use of pearos.xyz, operated by Pear Software and Services S.R.L. (CUI 50888207, Nr. Reg. Com. J2024041454000), an independently run open-source project, registered office at 133 Dacia Blvd, Floor D, Sector 2, Bucharest 020056, Romania, reachable at alex@pear-software.com. By using this site, you agree to them.
1. About pearOS
pearOS is a free, open-source Linux distribution. Its source code is licensed under the GNU General Public License v3.0 (GPL-3.0). This website's own content, design, and branding ("pearOS", the logo, and related marks) are not covered by that license and remain the property of Pear Software and Services unless stated otherwise.
2. Downloads and premium access
The free pearOS builds are free to obtain and always will be: by default their downloads are rate-limited to approximately 2 MB/s. In the on-site prompt you can instead pay an amount of your choice (not less than the minimum shown) for premium access: a temporary, individually signed download link that removes the speed limit for 4 hours. The software is the same free software either way; what you pay for is the premium access (faster delivery of the file), and your payment also supports the project. The paid UltraC0re (BSD) build is covered in section 3.
3. Paid builds (UltraC0re BSD)
Some pearOS builds are sold for a price. Today that is pearOS UltraC0re (BSD), a Developer Preview, which is available only against payment, at the minimum price shown at checkout. What you pay for is the pre-compiled, ready-to-boot build and its download at full speed. Your rights in the software itself are set by the licenses of its components; nothing here limits them.
Experimental software. UltraC0re is an experimental Developer Preview and a work in progress. It is unfinished, has been tested on very little hardware, and is not meant for daily use or for any system you depend on. Things will break, features are missing, and parts of the system change from one build to the next. Keep your own backups and do not use it for important data. Known limitations include:
- there is no installer yet: the ISO boots (UEFI) straight into the desktop;
- there is no web browser;
- GPU acceleration does not work in any virtual machine; everything is rendered by the CPU;
- Wi-Fi, Bluetooth and GPU support are still limited.
This list is not exhaustive. No support, updates or availability are guaranteed, and older builds may stop being available as development continues.
Price. The price shown at checkout is the price you pay. Where Pear Software and Services S.R.L. is the seller, it is not registered for VAT; where Stripe is the seller (see section 4), tax is calculated and shown by Stripe at checkout and on your receipt.
Delivery. After payment you receive a personal download link, valid for 4 hours, an email confirming your order, and your login details. The file is an .iso.xz archive: extract it before use. Please do not share your link.
No refunds; withdrawal right. This is digital software delivered immediately, so payments for it are final. By completing the payment you expressly request immediate performance and acknowledge that, once the download link is issued, you lose the statutory 14-day right of withdrawal (Article 16(m) of Directive 2011/83/EU, as transposed into Romanian law by OUG 34/2014). We ask for this consent and for your acknowledgement that the software is experimental before you pay, and record them together with the time and your IP address. When a refund is possible, and your statutory rights that cannot be excluded, are explained in our Refund Policy.
4. Payments, premium access and donations
Premium access (section 2) is pay-what-you-want above the minimum shown in the prompt. It is a payment for a digital service, not a gift: in return you get the unlimited-speed download link for 4 hours. We describe it as supporting the project because the money funds development, hosting and releases, but it is a purchase and a receipt is issued for it. If you need an invoice made out to your company, email alex@pear-software.com with your company details and the payment reference.
Who sells to you. Payments are processed by Stripe under its own terms; we never receive or store your full card details. For some payments Stripe acts as merchant of record: the checkout page and your receipt then say “Sold through Link”, Stripe is the seller, it calculates and collects the applicable tax, issues receipts and invoices, and handles refund requests and disputes, and its terms apply together with these. Otherwise Pear Software and Services S.R.L. is the seller.
Withdrawal right. By completing a payment for premium access you expressly request immediate performance of this digital service and acknowledge that, once the download link is issued, you lose the statutory 14-day withdrawal right under Article 16(m) of Directive 2011/83/EU as transposed into Romanian law by OUG 34/2014. For paid builds the same applies, as set out in section 3.
Donations. Gifts that give nothing in return (for example via PayPal, Ko-fi or Patreon, not tied to any download) are voluntary, are not exchanges for goods or services, and the withdrawal right does not apply to them in the first place. They are processed by those services under their own terms.
Refunds. When a refund is possible is explained in our Refund Policy. Mistaken or duplicate payments can be reported to alex@pear-software.com and will be reviewed case by case.
5. Acceptable use
- Do not attempt to circumvent, abuse, or overload the download or payment infrastructure.
- Do not resell or redistribute unlocked download links.
- Do not use this site to distribute malware or engage in unlawful activity.
6. Third-party services
This site links to and embeds third-party services (Stripe, PayPal, Ko-fi, Patreon, GitHub, Cloudflare, Google, Microsoft) that operate under their own terms and privacy policies, which we do not control.
7. Disclaimer of warranties
This site and the pearOS software are provided "as is", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or uninterrupted availability. As stated in the GPL-3.0 license, the software carries no warranty to the extent permitted by applicable law.
8. Limitation of liability
To the maximum extent permitted by law, Pear Software and Services will not be liable for any indirect, incidental, or consequential damages arising from your use of this site or the software it distributes.
9. Governing law and dispute resolution
These terms are governed by Romanian law. If you are a consumer and have a complaint that we haven't resolved directly, you may refer it to the National Authority for Consumer Protection (ANPC) through its Alternative Dispute Resolution platform at reclamatiisal.anpc.ro (SAL).
Note: the European Commission's Online Dispute Resolution (ODR) platform was permanently discontinued on 20 July 2025 and is no longer available. The list of national alternative dispute resolution bodies across the EU is maintained at consumer-redress.ec.europa.eu.
10. Changes to these terms
We may revise these terms from time to time. Continued use of the site after a change constitutes acceptance of the revised terms.
